Complaint Case Update (Please Make Comments)

Our case before the APSC is still pending and, as far as we know, the public may still make comments to the APSC by going here:

Please note that the the deadline date for Carroll Electric’s No Spray Request is Thursday March 15th.

20th Annual Hot Springs Documentary Film Festival


“The Natural State of America” will be playing in two theaters on opening night of the historic documentary festival in Hot Springs, AR!  The screenings will start at 7:00 PM and 7:30 PM on Friday, October 14.  More news to come!!!

Class Action Suit Filed Against Carroll Electric Board!!!


Dear Concerned Carroll Electric Members and Supporters,

This is to inform you that a class-action complaint has been filed with the Arkansas Public Service Commission on behalf of members of Carroll Electric Cooperative and against its board of directors and management, seeking increased transparency, more democratic governance, repayment of capital credits, a halt to the use of herbicides without the landowners permission and more. A synopsis is attached below and the entire complaint may be seen here. The plaintiffs are Dane Schumacher and Gordon Watkins, representing the membership of Carroll Electric.

Legal recourse was taken following much careful consideration and only after more than three years of efforts to work with the CE board and management proved futile. Members have been repeatedly denied access to board meetings and minutes, have been denied the right to speak at members meetings, bylaws have been repeatedly changed to impede member participation and to make it virtually impossible to gain a seat on the board of directors. The property rights of members have been disregarded, with CE’s attorney implying that CE can do whatever they please on easements across landowner’s property. Members have been denied information about or access to their investment in the coop (capital credits).

This legal action is a last resort taken only after honest and good faith efforts were made to seek constructive change, efforts which were repeatedly rebuffed.

Carroll Electric and Making the Connection


Dear Concerned Carroll Electric Members and Supporters,

While some of you may have read the following editorial by Dane Schumacher some may not have seen it. With the CECC Annual Members Meeting approaching next week, we think Dane’s editorial captures our concerns with our co-op in a clear, succinct way and bears repeating.

Although the Annual Members Meeting, held on a Thursday morning, is scheduled for the convenience of the staff and board and is understandably an inconvenient time for working members, we nevertheless encourage everyone to make every effort to attend. Whether you are denied the right to to speak, or agree with what is said, your presence makes a statement and the more people who attend, the more powerful that statement will be. We hope to see you there on Thursday, May 26 at 10 am (registration 9 am- ID required), at the Carroll County Fairgrounds north of Berryville.

We are honored that “The Natural State of America” has been selected for the Made in Arkansas program at the 5th Annual Little Rock Film Festival! THANKS goes to everyone involved in the making of the film. The festival is June 1st-5th. Our film will screen twice. Once we know more information, we will post it. Time and Place announced for CE Annual Members Meeting


Dear concerned Carroll Electric members and supporters,

Carroll Electric has announced the time and location of the upcoming Annual Members Meeting as follows:

Date: Thursday, May 26, 2011
Time: Registration at 9 am, meeting begins at 10 am
Location: Carroll County Fairgrounds, at the junction of Hwy 21 and Hwy 221 North of Berryville

We understand from CE that an announcement will be mailed to members in a few days. When asked if members would be allowed to speak, staff indicated that the mailing would include a form to mail back comments. The meeting agenda has not yet been determined.

Please make every effort to attend this meeting, the only CE meeting which members are permitted to attend. Spread the word and encourage your friends and neighbors to attend as well but understand that only members of record will be allowed to register and enter the meeting. Nevertheless, CE’s activities as the single largest land manager in the region, with over 9,000 miles of easements, affects everyone, members and non-members alike. Whether you live off the grid or have a different service provider, please help us turn out a large number of Ozark citizens who have serious concerns about CE’s practices and the uncooperative manner in which they treat their members. Remember, as CE members, we are also owners. This is our cooperative and we have both the right and the responsibility to make our concerns known.

Carroll Electric Petition Update


Dear Concerned Carroll Electric members and supporters:

Carroll Electric CEO Rob Boaz has denied Marcie Brewster and her canvasser’s request for a recount and list of invalid signatures. Additionally, Mr. Boaz has turned over the petitions and back-up documents to CE’s attorney, John Everett, and has informed Ms. Brewster and her supporters to direct any further questions concerning the petitions to Mr. Everett.

Wayne Schumacher, CE member and canvasser, contacted Mr. Everett and made a request to view and/or copy the petitions. Mr. Everett indicated that he could set up in a corner at his office one weekday morning and review the petitions. A follow-up call was made on Friday April 22 to verify this arrangement as well as ask for a copy and a chance to review back up documents. On Monday April 24, John Everett replied that we cannot have a copy and the earliest we can review the petitions is May 23 at 10:00 am. This is three days before the Annual Meeting.

We have included links to the most recent articles and letters to the editor regarding the petition process and denial by CE. We encourage everyone to write letters to the editors of your local papers to keep this issue alive.
